" P5 B1 O0 K; O2 @+ a洽洽公司获悉其商标在德国被欧凯公司抢注后,立即与欧凯公司取得联系,希望能通过协商解决问题,但是协商未果。为讨回商标,洽洽食品公司找到了北京市律师协会外事委员会副主任杜宝成律师。杜宝成先向德国欧凯公司发出一份措辞强烈的律师函进行警告,声明中国洽洽公司在WIPO (世界知识产权组织)注册了“洽洽”商标,受到法律保护,要求欧凯公司在德国商标局更改注册,将“洽洽”商标无条件归还,并限期十天答复。几天之后,欧凯公司从德国回函,要求洽洽交付20万欧元的转让商标费。洽洽拒绝了这一要求,并于今年1月向德国慕尼黑地方法院递交了起诉书。 今年3月1日,慕尼黑地方法院正式受理洽洽起诉欧凯公司的申请并通知欧凯公司。杜宝成说:“商标注册不是谁抢走了就一定能获取利益,手段是否正当,是知识产权案件审判中的重要依据。”因欧凯公司的行为具有恶意注册的性质,洽洽公司还依据德国法律,提出了惩罚性赔偿的要求。要求欧凯赔偿因恶意抢注“洽洽”商标造成的损失15万欧元,并且承担所有诉讼费用。+ q" }" Y: m/ ^! q
