Kind 9 III GG protects the operating liberty, therefore also the conclusion of collective agreements and thus necessarily also the obligatory penetration by means of labor disputes. Disputes around the labor disputes are to be delivered after §2 I No. 2 ArbGG before the labor courts. Labor disputes are the practice of pressure by collective disturbances of the work enterprise. Main kinds are strike and lockout. Other less relevant weapons are on on side the boycott or the operating blockade, on the AG side the barrier (no attitude of union members).


A strike is present, if a larger number of TO (collective measure) the work lays down together according to plan temporarily, in order to achieve a tariff-referred goal. With the general strike the entire working population puts the work in completely Germany down (never Trade Union of German Employees natures). With the Vollstreik all put the work in ON contested wage area down. However the partial strike is most frequent, here puts only to of a certain enterprise the work down (substantially more economically for the trade unions!). There is also the so-called go-slow strike, dh service according to regulation.

With the token strike to put the work activity at expiration of a collective agreement down (due to the Friedensplicht), but as a precaution already before the failure of the new collective bargaining. After hL a token strike is illegal, because a strike is inadmissible so long, as a collective wage agreement is possible by negotiations alone still. Differently the iurisdiction, since short token strikes can accelerate the collective wage agreement.

A political strike (enforcement of new work laws) is illegal, because it is not directed against the social opponent. Also outlaw strike is illegal, because he was not organized by a trade union.
